SafeYum Terms of Service

These Terms of Service ("Terms") govern your use of SafeYum ("SafeYum," "we," "our," or "us") and our website, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

  • You must be 18 years of age or older to create an account and use the Service.
  • Parents and legal guardians may create profiles for their children and other family members to track food exposures and trials.
  • Minors may not create accounts or independently use the Service. The Service is designed to be used by adults on behalf of children.

2. Description of the Service

SafeYum provides tools that help families track food exposures, food trials, symptoms, reactions, and related notes for family members. The Service is intended for informational and record-keeping purposes only.

SafeYum is not a medical provider and does not offer medical advice, diagnosis, or treatment. You should always consult a qualified healthcare professional with any medical questions or decisions related to allergies, food trials, or health conditions.

3. Your Account and Responsibilities

When you create an account, you agree to:

  • Provide accurate and current information.
  • Maintain the security of your login credentials.
  • Promptly update your information if it changes.
  • Use the Service only for lawful purposes and in accordance with these Terms.

You are responsible for all activity that occurs under your account. If you believe your account has been compromised, you must notify us promptly at support@safeyum.com.

4. Family Members and Child Profiles

The Service allows you to create profiles for family members, including "trial users," who are often children undergoing food trials.

By creating or managing these profiles, you represent and warrant that:

  • You are the parent or legal guardian of each child profile you create, or
  • You have full legal authority from the parent or guardian to enter and manage information about that child.

You agree not to enter information about any child for whom you do not have this legal authority.

5. Acceptable Use

You agree not to:

  • Use the Service in any way that violates applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Service or related systems.
  • Interfere with or disrupt the operation of the Service.
  • Upload or transmit malware, viruses, or harmful code.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service as a clinical or diagnostic tool for medical decision making.

6. Subscriptions and Payments

SafeYum may offer paid subscription plans in the future. If you choose a paid plan, the details of pricing, billing frequency, and included features will be presented to you at the time of purchase.

Unless otherwise stated at the time of purchase:

  • Subscriptions may automatically renew at the end of each billing period.
  • You may cancel future renewals at any time through your account or app store settings, where applicable.
  • Payments are non-refundable except where required by law or explicitly stated in our refund policy at the time of purchase.

7. Intellectual Property

The Service, including all content, features, functionality, software, design, and branding, is owned by SafeYum or its licensors and is protected by intellectual property laws.

SafeYum and related logos, names, and designs are trademarks or service marks of SafeYum. You may not use them without our prior written consent.

You retain ownership of the data and content you submit through the Service. By using the Service, you grant SafeYum a limited, non-exclusive, worldwide, royalty-free license to host, store, and process your content solely for the purpose of operating and improving the Service.

8. License to Use the Service

Subject to your compliance with these Terms, SafeYum grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own household's food tracking and record keeping.

This license does not allow you to resell, sublicense, or commercially exploit the Service, nor to copy, modify, or create derivative works based on the Service.

9. Termination

You may stop using the Service at any time. You may also request deletion of your account and associated data by using in-app tools (where available) or by contacting us.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that:

  • You have violated these Terms.
  • Your account is being used in a fraudulent or harmful manner.
  • We are required to do so by law or court order.

Upon termination, your right to use the Service will cease. Some provisions of these Terms, including those related to intellectual property, disclaimers, limitations of liability, and indemnification, will continue to apply after termination.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

SafeYum does not warrant that the Service will be uninterrupted, error free, secure, or free of harmful components, or that the information provided by the Service is complete or accurate.

The Service is not a substitute for professional medical advice. You understand and agree that you are solely responsible for any decisions related to food exposures and health, and that you will consult a qualified healthcare provider for medical guidance.

11. Limitation of Liability

To the fullest extent permitted by law, SafeYum and its owners, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.

To the extent permitted by law, SafeYum's total liability for any claim arising out of or relating to the Service or these Terms will be limited to the amount you paid to SafeYum for the Service in the twelve months prior to the event giving rise to the claim, or twenty-five United States dollars (US $25) if you used the Service without paying any fees.

12. Indemnification

You agree to indemnify, defend, and hold harmless SafeYum and its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use or misuse of the Service.
  • Any content or information you submit or enter into the Service.
  • Your violation of these Terms or applicable law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California and the laws of the United States, without regard to conflict of laws principles, unless the laws of your country require otherwise.

Any dispute arising out of or related to these Terms or the Service will be resolved in the courts located in California, United States, unless applicable law provides you with a right to bring claims in your local courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If changes are significant or required by law, we may provide additional notice through the Service or by email. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.
